OOTD is a community-based fashion-specialized SNS that shares fashion trends with people. Before purchasing fashion items, it provides a platform service where users can search for people with similar body specifications and share their own fashion with others to check fashion trends at once. OOTD provides terms and conditions with its service to facilitate smooth service use for its users. OOTD has provided a reasonable opportunity for service users to review the terms and conditions, and members confirm their agreement to these terms and conditions.

Unless otherwise indicated, all names, graphics, designs, logos, page headers, button icons, scripts, commercial markings, trade dress, and service names included in the Service are trademarks of OOTD or its licensors, sponsors or suppliers and are protected by trademark laws. The trademarks may not be used in any manner that is likely to cause confusion to, or in any manner that disparages or discredits, OOTD.
OOTD and its Logo are, without limitation, among the registered trademarks of OOTD and its Affiliates. Infringement of any OOTD trademark is not permitted.

All content including product designs (including any and all collateral materials relating thereto) included on this Service are owned by OOTD and/or its licensors and protected by copyright laws and/or design patents. You agree not to use, display, reproduce, retransmit, modify, distribute, disseminate, sell, publish, create derivative works of, broadcast, circulate, display or in any way exploit any such content, in whole or in part, whether by e-mail or by any other means, for any purpose other than for your personal, non-commercial use as set forth herein. You are not allowed to use any product designs without OOTD express written agreement.

Some contents include product descriptions along with other contents such as photos, affiliated links, etc. These descriptions can be submitted by the user(author of the original content), any other users, any other 3rd parties, affiliates, or by OOTD service providers(“Us”). OOTD attempts to be as accurate as possible in its product descriptions when needed. However, OOTD does not warrant that product and price descriptions or other content of this site are accurate, complete, reliable, current, or error-free.

Visitors may submit suggestions, ideas, comments, questions, or other information, to our User Service Department so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content.
If You do submit material, You automatically grant OOTD and its Affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media throughout the world. You grant OOTD and its Affiliates and sublicensees the right to use the name that You submit in connection with such content, if they choose. You represent and warrant that You own or otherwise control all of the rights to the content that You submit; that the content is accurate; that use of the content You supply does not violate these terms of use and will not cause injury to any person or entity; that the content you supply does and will not infringe any party’s intellectual property, publicity, privacy, or other rights and that such content is and will not be defamatory or libelous; and that You will indemnify OOTD or its Affiliates for all claims resulting from content You supply. OOTD has the right but not the obligation to monitor and edit or remove any activity or content. OOTD takes no responsibility and assumes no liability for any content shared by You or any third party through the OOTD Service.

You hereby represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. THE SERVICE IS NOT AVAILABLE TO PERSONS UNDER THE AGE OF THIRTEEN (13) OR TO ANY USERS SUSPENDED OR REMOVED FROM THE SERVICE BY OOTD. BY USING THE SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST THIRTEEN (13) YEARS OF AGE AND HAVE NOT BEEN PREVIOUSLY SUSPENDED OR REMOVED FROM THE SERVICE. The Service is not intended for users under the age of thirteen (13), and Service Provider does not knowingly collect personally identifiable information from users under the age of thirteen (13). Anyone person under the age of thirteen (13) is expressly prohibited from submitting their personally identifiable information to us, and from using portions of the Service for which registration is required, such as our forums and chat areas; any information submitted by such users will not knowingly be used, posted, or retained by us. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, deceptive, misleading, out of date, or incomplete, or if OOTD suspects that such information is untrue, inaccurate, deceptive, misleading, out of date, or incomplete, OOTD has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). Your profile may be deleted and your membership terminated without notice or warning if we believe that, for example and without limitation, you are i) under thirteen (13); ii) you are under eighteen (18) but represent yourself as eighteen or older; or iii) you are over eighteen (18) and represent yourself as under eighteen (18).
OOTD reserves the right to refuse or terminate service, including membership, for any reason.

Your privacy is important to us. Please review our Privacy Policy carefully to understand OOTD collection, use, and disclosure of your personal information. You hereby consent and agree to abide by our Privacy Policy and to stay informed of any changes to the posted policy.

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not OOTD, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. OOTD does not control, review, moderate, or otherwise monitor the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will OOTD be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
You agree not to do or attempt any of the following in connection with the Service:
1. harass, threaten, stalk, embarrass or cause distress, unwanted attention or discomfort upon any other person,
2. include sexually explicit images or other content which is offensive or harmful to minors,
3. include any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful material, including but not limited to material based on a person's race, national origin, ethnicity, religion, gender, sexual orientation, disablement or other such affiliation,
4. impersonate any person or the appearance or voice of any person,
5. utilize a false name or identity or a name or identity that you are not entitled or authorized to use,
6. violate any operating rule, regulation, procedure, policy or guideline of OOTD as published on the OOTD Service,
7. may infringe the intellectual property rights or other rights of third parties, including trademark, copyright, trade secret, patent, publicity right, or privacy right, or
8. distribute software or other Content in violation of any license agreement.
9. use the Service to solicit users directly for commercial purposes without prior written authorization from OOTD. Designers, Boutique Owners and Retatilers may promote their services, subject to i) common sense and good judgment, ii) OOTD review, and iii) specific requirements regarding use of the Service for commercial purposes that OOTD may, from time to time, communicate directly to Designers, Boutique Owners and Retailers individually;
10. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
11. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
12. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
13. access the Service from territories where its contents are illegal is prohibited (those who choose to access the Service from other locations do at their own initiative and are responsible for compliance
14. use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission or bypass our robot exclusion files or other measures we may use to prevent or restrict access to the Service; or
15. collect or store personal data about other users, in connection with the prohibited conduct and activities set forth in paragraphs above or otherwise.

THIS SERVICE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED BY OOTD ON AN "AS IS" AND "AS AVAILABLE" BASIS. OOTD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION AND AVAILABILITY OF THIS SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS PRESENTED ON THE SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, OOTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. OOTD DOES NOT WARRANT THAT THE SERVICE, ITS SERVERS, OR E-MAIL SENT FROM OOTD ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR ERRORS. OOTD WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS WEBSITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. We will provide You with timely notice of any such claim, suit or proceeding.

Any dispute in connection with the interpretation of these Rules shall be governed by the laws of South Korea. It is agreed that any lawsuit that may result in connection with these Rules shall be submitted to the exclusive jurisdiction of the Seoul District Court for the first trial.

By Your continued use of this site, You acknowledge that You have read and understand these Terms of Use and You agree to act in accordance with its terms and conditions and be bound by them. These Terms of Use shall not be altered or modified in any way without the prior written consent of OOTD. OOTD failure to act with respect to a breach by you or others does not waive OOTD right to act with respect to subsequent or similar breaches.
If You are acting as an agent for a principal (including on behalf of Your employer), You and the principal, jointly and severally, assume all of Your obligations set forth in this Agreement.
If any part of this Agreement is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of this agreement shall continue to be valid and enforceable to the fullest extent permitted by law.
